People that have sold their propery in Spain between July 2004 and December 2006 can claim money back
from the Spanish tax due too much paid tax when they sold their house.
The European Commission ruled it's against the law that non Spanish residents pay 20% more over gain value of the property.
Non Spanish residents that sold their property between 2004 and 2006 paid 20 percent more. The so called 'Capitol Gain Tax (CGT)'
for non residents was 35 percent while Spanish resident only had to pay 15 percent. The European Commission ruled that Spain was
not allowed to put this extra tax on.
According to Spanish lawyers, ex-property owners can claim back the 20% too much paid tax including 6 procent rent from the time
the CGT was paid. On average this is about 25.000 euros.
Property experts 'Property Casa' say that the Spanish tax department will have to pay a total of 53 million back to Brits.
There are a few conditions for the claim :
- You have sold you property between July 2004 and December 2006
- You need to have a copy of your Spanish tax form 'Modelo 212' this you filled in when you sold you property
a form 210 is also ok. (In Spanish : Agencia Tributaria. Impuesto sobre la Renta de no Residentes Modelo 212)
- Claim has to be with in 4 years after you sold your property.
